   Hi, We are commercial landscapers and we had one of our suppliers provide a product called structural soil, which we installed. When it came to compacting the structural soil, it wouldn't compact and the clients engineer issued us a non-compliance notice, we had to excavate the defected structural soil and remove to the tip then supply and install new structural soil from a different company. The total amount of structural was 800 ton so this was a very costly process totalling just over $320,000.00. My question to you is can we submit an Adjudication Application and run the claim through the Building and Construction Industry Security of Payment Act 1999 (NSW)? The supplier of the structural soil has the Security of Payments statement on their invoice's (This is a payment claim made under the Building and Construction Industry Security of Payment Act 1999 NSW) I would really appreciate if you could let us know how to proceed as i have already a 17(2) Notice as they didn't send a payment schedule within the timeframe allowed under the act. They have now issued us a payment schedule and i need to know if i can go to the Adjudication process in SOPA Thank you for your time.
